Welcome to the Operative website; www.operative.pro, hereinafter referred to as the “Website”. At Operative, hereinafter referred to as “we”, “us” or “the company”, the data is the basis of our services. We attach great importance to the privacy of our customers and visitors and will make every effort to comply with the privacy legislation imposed by the EU General Data Protection Regulation (GDPR) in any situation. We process personal data when you use our website, our services or because you provide this information to us yourself. Purpose and basis

We process personal data for the following purposes:

◦ To be able to call or email you when necessary to perform our services;
◦ Informing you about changes to our services and products;
◦ To offer you the opportunity to create an account;
◦ To deliver products and services to you (digital and/or physical);

Special and/or sensitive personal data processed by us

Our website and/or services do not intend to collect information about website visitors who are under 16 years of age. Unless they have permission from parents or guardians. However, we cannot check whether a visitor is older than 16. We therefore recommend that parents be involved in their children's online activities to prevent data about children from being collected without parental consent. Personal data that we can process

We process personal data because you use our services and/or because you provide this information to us yourself. Below is an overview of the personal data that we process:

◦ Data about your activities on our website (e.g. heatmaps, times of actions, modules/functionalities that you use the most and least, etc.)

◦ All other personal data shared voluntarily with Operative. (e.g. in correspondence and/or by phone)

This information can also be personal data that we obtain from other sources, such as personal data from the Chamber of Commerce's Trade Register, the Land Registry and personal data available on public (business) websites. We can also receive personal data from you from other parties.

When it comes to processing payments for goods or services, here we rely entirely on an external payment provider. It only processes your bank details for the purpose of properly processing the requested payments. The necessary security measures are provided via SSL encryption. We do not have access to your bank details in any way ourselves.

Retention periods

We keep personal information for as long as necessary to provide our services and to comply with our legal obligations, resolve disputes, and enforce our policies. When determining the retention periods, the nature of the information that is collected, the purpose for which that information is collected and the requirements that apply to the situation are taken into account. We keep records of customer personal information, account opening documents, messages, and other matters as required by law and regulations. We can always correct, supplement or delete incomplete or incorrect information upon request.

(Sub) processors and third parties

Apart from the cookies we may use (see: Cookies), the data that we process about you on this website is not processed by third parties. Sometimes, however, it may be necessary to share your personal data with third parties. For example, it may be necessary to share your personal data with judicial authorities or with a counterparty. To ensure that the request for inspection has been made by the lawful person, we kindly ask you to include a copy of an identity document along with the request. To protect privacy, we request that you black out your passport photo, MRZ (“machine readable zone”, the strip with numbers at the bottom of the passport), passport number and social security number (BSN) in this copy.

To protect you as a website visitor, Operative uses secure encryption technologies. With SSL (Secure Socket Layer), your personal information is used encrypted on our site (therefore not visible to third parties). The Data Protection Authority checks whether companies comply with the General Data Protection Regulation. If you believe that we are not complying with applicable privacy laws, please contact us.
